These new terms and conditions take effect February 20th, 2026.

At Epatches, we believe business should be personal. We are a hard-working bunch, and we pour our hearts into every single patch we create. Because we value the trust you place in us, we have designed these terms to ensure we are always on the same page. We believe in being honest and helpful, treating everyone with the respect and dignity they deserve.

1. Our Partnership

These terms govern your use of our website and your relationship with 1497202 Alberta Ltd., doing business as Epatches (referred to throughout this document as "we", "us", or "the Company"). By using our site, you signify your consent to these terms. We want your experience with us to be nothing short of great.

2. Privacy & Personal Information

We are in this together, and that means we look out for your personal info. We only collect what we need to get your Epatches items to your door. We promise never to sell, rent, or lease your contact info to others. For the full details on how we keep your data safe, please visit our privacy policy.

3. Accuracy and Availability

Ownership of Content

The website and its original content, features, and functionality are owned by Lori St. Martin and operated by 1497202 Alberta Ltd. All materials, including text, graphics, logos, and software, are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. We put a lot of heart into what we create, and we appreciate your respect for that!

Trademarks

The term "Epatches" is a registered trademark. Any use of the Epatches name, logo, or branding without our express written consent is strictly prohibited. We want to ensure our brand remains a consistent symbol of quality for all our clients.

Limited License

We are happy to grant you a limited, non-exclusive, and non-transferable license to access our site for personal or business inquiries, such as requesting quotes or ordering products. To protect the integrity of our work, you may not reproduce, distribute, or create derivative works from any part of this website without prior written authorization from us.

Accuracy & Availability

We work hard to ensure everything on our site is accurate and up to date. Because we are always growing and adding new designs that "pop," we reserve the right to change product details, prices, and availability at any time. If we ever have to cancel an order due to an inventory glitch or a pricing error, we’ll reach out to you directly to explain and ensure you aren’t charged.

4. Intellectual Property

  • Our Creativity: We put a lot of heart into our designs. The website and its original content are owned by our founder, Lori St. Martin, and are protected by law.

  • Our Name: "Epatches" is a registered trademark. We ask that you not use our name or logo without first checking with us.

  • Your License: You are welcome to use our site for personal or business use, like grabbing quotes or ordering patches to express yourself!

5. The E-Rewards Community

Membership is a free way for us to reward you! To keep things fair and secure for everyone, we allow one account per person. Creating multiple accounts (even with different email addresses) isn't allowed and will, unfortunately, result in the closure of those accounts and the loss of any points earned.

Your Account, Your Responsibility

We’re in this together, which means we count on you to keep your information, especially your email, accurate and up to date. You are the captain of your account! Please keep your password safe and don't let others use your login. If you ever notice anything suspicious or think someone else has accessed your account, let us know right away so we can help you secure it.

Personal & Non-Transferable

Your E-Rewards are just for you. Because this is a personal membership, points and benefits cannot be sold, assigned, or transferred to anyone else. Any attempt to move points to a third party will be considered a violation of our community rules.

Community Standards & Termination

Membership is a special benefit we offer to our community members who follow the rules. To keep Epatches a great place for everyone, we reserve the right, at our sole discretion, to:

  • Update, decline, or delete an account at any time.
  • Monitor accounts to ensure everyone is playing by the rules.
  • Terminate accounts for any violations, which results in the loss of all points and data associated with that account.

Our Discretion

Epatches reserves the right to refuse membership or limit access at any time, with or without notice. This usually only happens in serious cases, such as:

  • A breach of these Terms.
  • Requests by law enforcement.
  • Technical or security issues.
  • Fraudulent, illegal, or abusive behaviour.
  • Non-payment for services.

Termination means immediate loss of access to membership perks and the permanent forfeiture of all points. Epatches is not liable for any loss resulting from the termination of an account.

Cancellation

If you ever need to leave us (though we’d be sad to see you go!), you can cancel your membership at any time through your account dashboard or by reaching out to us for help.

The Fine Print on Points

No Cash Value: E-Rewards points are promotional "thank yous" intended for discounts on future fun. They have no cash value, are not your property, and cannot be traded for currency.

Changes to the Program: We’re always looking for ways to improve! We reserve the right to modify, pause, or end the E-Rewards program (including how points are earned or their value) at any time without prior notice.

Age Requirement

By creating an account, you’re confirming that you are at least 18 years old (or the age of majority where you live). We do not knowingly collect information from anyone under 18.

6. Payment & Security

We believe in honest, straightforward service, and that includes making sure your payments are handled with care.

  • How to Pay: We accept a variety of ways to get your order started!

    • Credit & Debit: We accept Visa, Visa Debit, and MasterCard.

    • Regional Cards: We welcome American Express (for our Canadian neighbours).

    • Digital & Direct: We also accept PayPal, e-transfers, and direct deposits.

    • Traditional Methods: If you prefer, we accept money orders and even business cheques.

    • Note on Manual Payments: If you choose a money order or cheque, please keep in mind that we’ll start working on your order as soon as the funds have safely cleared our bank.

  • Currency & Taxes: We want to make shopping easy! You can select your preferred currency (CAD or USD) using the link in our website menu. Please note that all orders are subject to applicable provincial and federal taxes (like GST) based on where we are shipping your items or if you are picking them up.

  • Security First: Your safety is our priority. WE DO NOT STORE CREDIT CARD INFORMATION ON OUR WEBSITE. All credit card transactions are processed through secure, third-party, encrypted gateways to ensure your financial safety.

  • Local Pick-up (Sylvan Lake): If you’re in our neck of the woods, we’d love to see you! Local pick-up is available at our Sylvan Lake office. Please ensure your order is prepaid through our secure online methods before you stop by.

7. Custom Orders: Bringing Your Vision to Life

We love helping you create something unique! We offer Client Care, not just customer service, because we focus on the person behind the patch. Because custom projects require a little extra "elbow grease" from our design team, we have a few specific policies to keep the process moving smoothly.

  • Getting Started (The Deposit): To begin the design and administrative work for your unique project, we require a $50 non-refundable deposit (plus applicable taxes). This ensures our hard-working designers can dedicate the time needed to make your vision come to life.
  • Payment Options: We accept the same secure methods listed above.

  • A Quick Note for Canadian Banking: If you are banking within Canada and choosing to pay via e-transfer or direct deposit, please note these are processed manually and may take just a little longer to clear.

  • Honest Pricing: We believe in doing what we say we are going to do. While we strive for perfection, we reserve the right to cancel an invoice if a technical error lists an incorrect price. In these cases, we will notify you, issue a full refund to your original payment method, and issue a new invoice.
  • Production: To meet your deadlines, we may approve a supplier sample on your behalf if time is short.
  • No Delivery Guarantees: While we provide estimated timelines, in-hand dates cannot be guaranteed due to potential shipping delays, customs hold-ups, or manufacturing variables beyond our control.
  • Third-Party Manufacturing: Epatches does not manufacture products on-site. We act as your quality-control partner and distributor, shipping all items from our location in Alberta, Canada.
  • Custom Order Returns: As these items are made to your unique specifications, all sales are final. Custom orders cannot be returned or refunded unless there is a clear manufacturing defect.
  • Our Standards: Epatches maintains specific standards regarding the content we produce. We reserve the right, at our sole discretion, to refuse quote requests or cancel orders that contain:
    • Profanity or offensive language.

    • Depictions of extreme violence or hate speech.

    • Content that infringes on the intellectual property or trademarks of others.

    • Any material we deem inappropriate at our sole discretion.

8. Custom Artwork Responsibility

We love seeing the incredible designs you come up with! Because we are "in this together," we rely on a mutual understanding of trust and legal responsibility when it comes to the art we produce for you.

  • Your Representation: By submitting artwork, logos, or designs to Epatches, you are confirming that:
    • You are the sole owner of the artwork or have express, written permission from the owner to use the design.
    • The artwork doesn’t infringe on anyone else's intellectual property, privacy, or publicity rights.
    • The design isn’t tied up in any licensing agreements that would stop us from manufacturing it for you.
  • Our Right to Refuse: We’re here to help, but we also value integrity. We reserve the right to refuse any order that we suspect might infringe on someone else's trademarks. Please note that our acceptance of an order isn’t a legal "green light" or a guarantee that the art is safe to use—that responsibility stays with you, the creator.
  • Indemnification (Your Legal Commitment): To keep our small business protected, you agree to defend and hold Epatches (including our officers and employees) harmless from any claims, damages, or legal fees that might arise if a third party claims your design infringes on their copyright or trademark.
  • Showcasing Your Success: We find joy in seeing our work in the wild! We will reach out to ask for your permission to use images of your finished patches in our marketing, on social media, or on our website to showcase our craftsmanship. We would appreciate your approval! Don’t worry—we love making your designs look great!

9. Shipping & Deliveries

We ship your orders with care from our head office in Sylvan Lake, Alberta, to customers all around the world. We use a variety of reputable carriers (like Canada Post, Purolator, UPS, and FedEx) to make sure your package arrives efficiently.

Timing & Processing

To help you plan, please keep in mind the difference between Processing Time (the time we need to get your order ready) and Transit Time (the time your package spends travelling with the carrier).

  • The Clock Starts: "Day 1" of transit is the business day after your order leaves our office.
  • Business Days: All our timeframes refer to Monday through Friday, excluding Canadian statutory holidays.

In-Stock Orders

  • Standard Processing: We usually ship in-stock items within two (2) business days.
  • Peak Seasons: During our extra-busy months (April, May, October, and November), it might take us 3–4 business days to get things out the door. We appreciate your patience while we work hard to get every order right!
  • Out-of-Stock Items: If something is unavailable, we’ll reach out to you. You can choose to wait and ship everything together or split the order (note: extra shipping fees may apply for split shipments).

Custom Orders

  • Standard Timeline: Quality takes time! Custom orders generally take 4–5 weeks from the date you approve your final proof. This includes creating your sample, manufacturing, and our rigorous quality control check back in Alberta.

  • Rush Orders: Need it faster? For a 10% surcharge, we can move your project to the front of the line. Because we’re moving quickly, rush-order samples are approved in-house. While we prioritize these, we cannot guarantee a specific delivery date.

Shipping Methods & Tracking

  • Choosing Your Method: For a full list of costs and timeframes, visit our Shipping Rates Page.

  • Regular Mail: This is our most affordable, uninsured option. Because it doesn’t include a tracking number, Epatches cannot be held responsible for items lost or delayed by the carrier.

  • Tracked Shipping: For urgent or high-value orders, we highly recommend selecting a tracked method. We’ll send you the tracking info as soon as it leaves our hands.

  • Third-Party Accounts: If you ask us to use your own courier account, we are not responsible for items lost, stolen, or damaged during transit.

International Shipping & Customs

  • U.S. Shipments: We aim to make shipping to our U.S. friends as seamless as possible!

    • Duties Included: For most standard orders, we handle the import duties and brokerage fees for you, so your package arrives without a knock at the door asking for extra change.

    • Exceptions: For exceptionally large or commercial-scale orders that fall outside our standard agreements, we reserve the right to invoice for those specific duties.

  • Other International Locations (Outside Canada & USA): If you are ordering from outside North America, your package may be subject to local taxes (VAT/GST), duties, or brokerage fees.

    • Customer Responsibility: These charges are assessed by your home country and are the responsibility of the person receiving the package.

    • Pro-Tip: We recommend checking with your local customs office so you know exactly what to expect when your Epatches arrive!

  • Legal Compliance & Honesty: As a registered commercial exporter, we value integrity. We cannot mark orders as "Gifts" to avoid fees; all packages will be marked with their accurate purchase value.

  • Customs Delays: Please remember that while we work hard to ship quickly, we have no control over international border delays or the time it takes for customs clearance.

10. Returns & Refunds

We want you to love your Epatches purchase! If something isn't quite right with your in-stock products, we are here to help make it right.

In-Stock Products

  • Exchanges: We are happy to exchange any in-stock product for another item within 120 days of the original sale date, as long as the item is still active on our website. 

  • Refunds: If you’d prefer a monetary refund, please let us know within 120 days of your purchase.

  • Condition: To be eligible for a return or exchange, items must be in new, resalable condition.

  • Exclusions: We cannot offer refunds or exchanges on discontinued or retired items.

Refund Details & Fees

  • The 15% Restocking Fee: For all monetary refunds, a 15% restocking fee is deducted from the product subtotal. This helps us cover the "elbow grease" required to inspect and restock items.

  • How You’ll Be Paid: We issue refunds back to your original payment method. For e-transfers or money orders, we’ll issue the refund via e-transfer or business cheque at our discretion.

  • Shipping Costs: Original shipping and handling fees are non-refundable.

  • Processing Time: Once we receive and inspect your returned items at our office, please allow 7-10 business days for us to process your refund or exchange.

Custom Creations

Because custom patches are manufactured to your unique specifications and designs, we do not accept returns or offer refunds on custom products. They are one-of-a-kind, just like your vision! We strongly encourage you to review your digital proofs carefully before giving us the final "thumbs up."

Defects & Damage

We stand behind our work! If you receive an item that is defective or damaged, please notify us immediately. We will provide a replacement for the same item at no additional cost to you. If we missed a detail, we’ll fix it; it’s that simple.

The Logistics

  • Proof of Purchase: A copy of your original receipt is required for every return. E-Rewards members can find these in the Members’ Area, and guests can always contact us for a copy.

  • Return Shipping: You are responsible for the postage costs to send items back to our Sylvan Lake office.

11. Discount Policy

We love helping you save while you create! To keep things fair and consistent for everyone, we use the following guidelines for our discounts and promotions.

How We Calculate Savings

Discounts are applied at the item level. To keep our pricing predictable, we use a standard rounding method where item prices are rounded to the nearest cent above $0.50.

For example: A $1.50 crest with a 15% discount comes to $1.275, which we round to $1.28.

Promo Codes & "Stacking"

  • Single Use: You can apply one promotional ("promo") code per order.

  • No Double-Discounting: To keep our prices sustainable, promo codes cannot be "stacked" or combined with other active sales, bulk discounts, or E-Rewards point redemptions unless we explicitly say otherwise.

  • Our Right to Adjust: Epatches reserves the right to modify, pause, or cancel any promotion or promo code at any time, for any reason.

Earning & Using Your Points

  • The Basics: You earn points on the net purchase price of eligible items (this excludes taxes and shipping).

  • Promotional Events: We love a good "Double Points" event! These promotions are only valid during their specific timeframes and cannot be applied retroactively to orders placed before the event started or after it has ended.

  • Exclusions: Points are not earned on the purchase of gift certificates or on the portion of an order where you’ve used points to pay.

  • Accuracy: If points are added to an account due to a technical glitch, system error, or fraudulent activity, Epatches reserves the right to adjust those balances to reflect the correct amount. We’re all about doing what we say and keeping things honest!

12. Orders, Changes & Quality Standards

Back-Orders (In-Stock Items)

Occasionally, our designs are so popular that demand exceeds our current stock!

  • Large Orders: If you’re planning a big event, we recommend giving us 3–4 weeks' notice to make sure we have everything you need ready to go.
  • Notification: If something is out of stock, we’ll let you know within 1–2 business days.
  • Your Options: You can choose to wait and ship everything together, or we can send a partial shipment.
  • Our Treat: If you choose to split the order, Epatches will cover the shipping costs for the back-ordered items! These are shipped via regular mail; if you’re in a hurry for the back-ordered pieces, we can upgrade to a faster method for an additional fee. Standard shipping rates will apply.

Order Changes & Cancellations

Because we’re hard-working and try to ship orders as fast as possible, time is of the essence!

  • Act Fast: If you need to change your order or shipping method, contact us immediately.
  • Case-by-Case: We’ll do our absolute best to help, but changes aren't guaranteed once our team has started processing. Once an order is shipped, it’s officially on its way and cannot be changed or cancelled.
  • Stay Updated: E-Rewards members can track their progress anytime via the Order History page.

 Defects & Errors

We stand behind our products. If there is a manufacturing defect or an error on our part:

  • Please contact us within 14 days of receipt.
  • We will work to correct the mistake, which may include a replacement or exchange at no additional cost to you.
  • We are not responsible for errors in the original artwork or "approved" proofs provided by the customer.

13. Community Ideas & Submissions

We love hearing from our community! Whether you’re sharing a brilliant camp plan, a favourite recipe, or a suggestion for a new patch design, your creativity helps Epatches grow. When you share these with us (which we call "Submissions"), a few standard rules apply:

  • License to Use: By sharing your idea, you grant Epatches a worldwide, "forever" license to use, publish, and even modify your content. This includes the right for us to turn your suggestion into a physical patch or use your testimonial in our marketing. This is how we keep our catalogue fresh and exciting for everyone!

  • Ownership & Originality: You’re confirming that the idea is your original work (or that you have permission to share it) and that it doesn’t step on anyone else’s intellectual property rights.

  • Non-Confidentiality: We’re an open and helpful community, so any material you send our way is treated as non-confidential. This allows us to share your great ideas with the whole Epatches family.

  • Content Standards: We want to keep Epatches a positive space. We reserve the right to edit or decline any submission. Offensive language, spam, or external ads aren't allowed.

  • Rewards: We love saying "thanks" for great ideas! While we often offer rewards (like a 15% discount) for shared plans or designs, these are issued at our sole discretion based on the specific terms of our submission page.

14. The Important Legal Bits

Limitation of Liability

We put a ton of care into our work, but we are a human team. To the maximum extent permitted by law, Epatches (operating as 1497202 Alberta Ltd.) shall not be liable for any indirect, incidental, or punitive damages, including loss of profits or data, resulting from your use of our site or products.

  • Our Limit: In any event, our total liability to you will never exceed the actual amount you paid for the specific order in question.

Disclaimer of Warranties

Outside of our "Defects & Errors" promise, all products are provided "as is." While we work hard to ensure every design "pops," we make no warranties regarding the fitness of a product for a specific purpose beyond our standard quality checks.

Alberta Jurisdiction & Governing Law

We are an Alberta-based company and follow the rules of our home province. These Terms & Conditions are governed by the laws of the Province of Alberta, Canada. By using our site, you agree that any legal proceedings will take place exclusively in the provincial or federal courts located in Alberta.

Severability

If a court ever decides that one part of these Terms isn't enforceable, don't worry—the rest of our agreement stays in full force and effect.

Your Agreement & Updates

By hanging out on the Epatches website, you signify your agreement to these Terms. We may update these terms occasionally to reflect how we grow or to make our processes even better for you.

  • How we'll let you know: If we make any significant changes, we’ll do our best to give you a heads-up! This might be through a notice on our homepage, a post in the E-Rewards member area, or a quick update in our newsletter.

Your Responsibility: It’s always a good idea to check this page periodically. Your continued use of the site after we post updates means you’re on board with the new terms.
